Swain’s romantic getaway turns into a life-or-death struggle
The case began in 2006 when a Rhode Island chiropractor, Dr. Richard Tyre, was drowned off the coast of the island. Though Tyre’s drowning was initially ruled accidental, the British Virgin Islands authorities charged Swain with her murder. At a civil trial in Rhode Island, Swain was found guilty of the fatal drowning, and was sentenced to life in prison. In court, his lawyers urged jurors to put any ill feeling toward him aside and focus on the case.
At trial, the jury decided that Swain, a former dive shop owner, was not only negligent, but also reckless. The jury was unanimous in convicting Swain of the death of his wife while on a scuba diving excursion. When the jury was reading the verdict, Swain, a Rhode Island resident, stayed silent, but his expression changed from horror to relief.
